Acceptable Use Policy (Last Updated - September 26th 2006)

1.  Introduction

1.1  1Rai.com, its sub domains and other sites (“the Sites”, “Our Sites”) and the Online Listing Manager (“the Service”, “Our Service”) are products of 5Phase Asia Pacific Co., Ltd. (‘We”, “Our” and “Us” ).  The aim of the Acceptable Use Policy is to ensure that Your use of the Sites and the Service is trouble free and that You have due regard for the law and the needs of other users.  This policy applies to all users (“You”, “Your”) of the Sites and the Service.

1.2  The Acceptable Use Policy is in addition to any other terms and conditions applicable to the Sites and the Service.

2.  Notification of Policy Changes

2.1  We may from time to time make changes to the Acceptable Use Policy. When We do, We will amend the "Last Updated" date displayed at the top of this page.  We encourage You to regularly review this policy so that You are aware of any changes. 

3.  Your Obligations

3.1  You and anyone else that accesses the Service under Your registration/subscription must:

·      Comply with this Acceptable Use Policy

·      Use the Service only for the purposes for which it was designed and offered and not for any other purpose, including those mentioned below as Unacceptable Uses

·      Use the Service in a responsible way, taking into account the effects Your use of the Service may have on other users of the Service and the Sites

4.  Acceptable Use

4.1  It is acceptable to use the Service for the genuine listing of property available for sale, lease or rent within the Provinces permitted by Your subscription, on behalf of the person entitled to offer the property for sale, lease or rent and in accordance with this policy.

5.  Unacceptable Uses

5.1  The practices detailed below are unacceptable uses of the Service and constitute a breach of this Acceptable Use Policy.

5.2  Listing anything other than property that is for sale, lease or rent.  For example, You must not list cars, boats, caravans and portable homes.

5.3  Listing property in a province that is not permitted by Your subscription.

5.4  Using the Service to advertise Your business rather than property for sale, lease or rent.  Each listing You upload must be a genuine listing of property that is currently available for sale, lease or rent. For example, it is unacceptable to advertise Your business as a property listing.

5.5  Placing irrelevant information in any of the fields used to upload property information.  You must only use the fields for their intended purpose. For example, inserting Your business name for the property description is not acceptable.  It is also unacceptable to insert a business logo for one of the property pictures.

5.6  Placing a contact name, phone number, email address, Web site address or any other contact information in the fields for a property is an unacceptable use of the Sites.

5.7  Displaying a photograph, drawing or other image that is not for the property being offered for sale, lease or rent.  If You do not submit a picture for a property, a default image is automatically inserted by the Service.

5.8  Creating more than one listing for the same property is not an acceptable use of the Service.  For example, listing a single property more than once, but with different prices is not acceptable. However, a genuine listing of multiple units at the same address is acceptable.

5.9  Removing a property and then listing the same property again so that it appears as a new listing is unacceptable use of the Service.

5.10  Pressing save to update a property without making any change to the property is an unacceptable use of the service.

5.11  Submitting animated files through the Service for display on the Sites.  For example: submitting an animated logo for display is not acceptable. You also must ensure that the graphic file submitted by You for Your logo is no larger than 4k in memory size.

5.12  Listing property that You have not been authorised to market for sale, lease or rent.

5.13  Copying the details of another agent’s listing to make Your own listing.

5.14  Impersonating someone or a business when using the Service.

5.15  Reselling the Service, the Site or its contents.

5.16  Using the Service to advertise properties for sale, lease or rent for another Real Estate Agency that should otherwise subscribe to the Service.

5.17  Publishing advertisements with the Service that contain a reference to a third party (for example, the Vendor).  Property listings must only refer a viewer to the Real Estate Agent that is a subscribing member of the Service.

5.18  Using the Service in a manner that may mislead or deceive the public users of the Site.

5.19  Using the Service for any illegal or improper purpose. For example, when using the Service it is unacceptable to display material that:

·         may defame or discredit another person or business

·         may disclose private, personal or confidential information

·         may be considered offensive, threatening or abusive

·         may infringe the intellectual property rights of others

·         may infringe any law, regulation, standard, content requirements or code effected by any relevant authority or industry body

6. Breaching this Policy

6.1  Any breach of the Acceptable Use Policy is a breach of Your agreement with 5Phase Asia Pacific Co., Ltd.

6.2  Breaching the Acceptable Use Policy may result in 5Phase Asia Pacific Co., Ltd. taking action in order to resolve the breach.  This may involve suspending Your subscription, removing property information submitted by You, or any other action that We are permitted to take under Our agreement with You and according to law.
